Wall Street boosts QE3 expectations after May jobs shock

NEW YORK/WASHINGTON (Reuters) - A much weaker-than-expected U.S. labor market alongside escalating financial turmoil in Europe raised Wall Street's expectations the Federal Reserve will intervene to protect the fragile U.S. economic recovery, according to a Reuters poll.

The median of forecasts from 15 primary dealers - the large financial institutions that do business directly with the Fed - showed a 50 percent chance the central bank would eventually launch another round of quantitative easing, known as QE3.

A similar poll done on May 4 resulted in the median of forecasts from 14 primary dealers giving a 33 percent chance of the Fed eventually undertaking QE3.

The latest poll was conducted on Friday after the government said employers added only 69,000 jobs to their payrolls last month, the smallest number since May of last year, and 49,000 fewer jobs were created in the prior two months than had been thought. The jobless rate also rose for the first time in nearly a year.

"We think that the odds of QE3 remain elevated and have risen somewhat on the back of today's data and the situation in Europe," said Michael Hanson, economist at Bank of America Merrill Lynch.

Weaker growth around the world and the rising risk of a full-scale financial crisis in Europe should Greece exit the euro zone threaten to deliver fresh blows to the United States.

Securities regulator FINRA lost $84 million in 2011

(Reuters) - The Financial Industry Regulatory Authority, the U.S. securities industry's self-funded regulator, lost $84 million last year on higher, one-time project expenses.

Weaker collection of fees due to low industry trading volume and thin returns on its investment portfolio also depressed earnings.

FINRA, whose top five executives received $6.86 million in compensation for 2011, said in its annual report released on Friday that it is seeking approval to raise fees for its brokerage firm members "in light of our robust regulatory responsibilities but static funding levels."

The loss at FINRA, formed through the 2006 merger of the National Association of Securities Dealers and the New York Stock Exchange, is its first since it bled $700 million during the depth of the financial crisis in 2008. The regulator's red ink, combined with relatively high executive compensation and the plan to raise fees, will weigh on an industry that is suffering from a weak economy, new regulations and investor caution.

Chief Executive Richard Ketchum, who received $2.68 million in salary, bonus and benefits last year, attributed the loss to "declining industry revenues and transaction volumes," from which FINRA collects fees, and a more conservative investment allocation policy.

The 2008 loss reflected huge deterioration in its investment portfolio.

FINRA, which oversees nearly 4,400 brokerages, registers 630,000 brokers and organizes arbitration proceedings for brokers and their clients, has been lobbying intensely to extend its regulatory sway to roughly 12,000 investment advisers. The thinly staffed U.S. Securities and Exchange Commission examines advisers roughly once every 11 years and is studying whether to hand those duties to a self-regulatory group.

The annual report also said FINRA incurred heavy expenses to build two data centers and an enhanced surveillance system during the year.

WARNING SIGNALS

Ketchum telegraphed problems at FINRA in April when he sent an email to members about plans to raise their fees because of a "significant loss."

The SEC, which oversees the self-regulatory group, last week approved FINRA's request for a 25 percent hike in equities trading fees. The increase, effective July 1, "is designed to ensure proper funding of FINRA's regulatory program," despite a continued decline in trading volume at brokerages, he wrote.

It also approved higher fees for new membership applications, review of corporate finance filings and other activities.

FINRA radically altered its investment portfolio in 2009 to avoid embarrassing losses, shifting to what it said was a conservative investing strategy. The group ended 2011 with a 2 percent return on a portfolio at year's end of about $1.5 billion. Just under 70 percent of the portfolio was invested in cash and bonds and 14 percent in equities.

The total return trailed Barclays US Aggregate bond index's return of 7.8 percent and just about matched the 2.1 percent return of the S&P 500 index.

A FINRA spokeswoman did not return a call for comment.

FINRA said in its report that it is engaged in aggressive cost-cutting, reducing its 2012 budget by $36 million from last year. It expects the belt-tightening efforts to result in nearly $60 million of savings by the end of 2013, Ketchum wrote.

A recent shuffling in FINRA's executive ranks may reflect the cost-savings campaign. The regulator recently hired a former SEC official to replace two top lawyers who left in May. One of those lawyers, former general counsel for regulation Marc Menchel, earned more than $1.6 million in total compensation in 2010. His 2011 pay was not disclosed.

FINRA's top public relations and lobbying executive, Howard Schloss, who earned $830,014 last year and over $1 million in 2010 is also leaving in September.

"They're doing the same cutting now that everyone else is doing because their money is tight as well," said David Sobel, general counsel and chief compliance officer of Abel/Noser Corp, a New York-based broker-dealer.

PAY CONCERNS

FINRA has long faced questions about whether its compensation packages for executives are overly generous for a regulator, albeit one that is privately run.

Ketchum's 2011 pay was virtually flat with the $2.6 million he received in 2010, according to the report. However, it towers over the $165,300 received by SEC Chairman Mary Schapiro in her government post. Schapiro earned much more when she was FINRA's chairman. She left for the SEC in 2009 with a package of pay and benefits worth $7.3 million.

"As FINRA looks to tighten its belt, it should take a close look at its lavish pay packages," said Michael Smallberg, an investigator with the Project on Government Oversight, a Washington-based watchdog group. "It's hard to see how FINRA can justify paying its officers seven-figure pay packages, especially when the organization is operating at a loss," he said.

The packages were too generous, Smallberg said, even though many of FINRA's top executives earned less in 2011 than in 2010. For example, Stephen Luparello, FINRA's vice chairman, earned $1.38 million in 2011, compared to $1.43 million in 2010. Martin Colburn, FINRA's chief technology officer, earned $1.05 million in 2010 and $972,698 in 2011.

Compensation for top FINRA executives is higher than at similarly structured organizations, said Steven Hall, a New York-based compensation consultant. He pointed to Fannie Mae and Freddie Mac, which now cap their pay at $500,000. Donald Layton, a longtime bank executive, became the head of Freddie Mac in May.

Fannie and Freddie CEOs earned as much as $6 million, with deferred pay and bonuses, before the companies were taken into government receivership in 2008 amid massive mortgage losses.

Some FINRA members said the high pay scale at the self-regulatory group is necessary.

"Better people don't come with less money," said Sobel, adding that Ketchum makes less than such predecessors as Schapiro and Frank Zarb. "FINRA does a government job, but it is not the government," Sobel said.

Facebook is invaluable as a forum for finding long-lost friends, not to mention sharing links, photos and personal videos. For better and worse, the site has even redefined the word "like."

Of course Facebook manages to use all of this goodwill to its own advantage. And the company often needs to be reminded that there are limits to how much it can exploit user information for profit.

Facebook has settled a class-action lawsuit that forces it to be more clear that clicking on the "Like" button means your name and photo can be used to endorse whatever movie, product or politician you "liked."

Most recently, Facebook surreptitiously modified user profiles to replace their original e-mail addresses with @facebook.com addresses. Mail sent to that address becomes a Facebook message to a user. You?d think that a company with so many loyal followers would have announced this ahead of time. That?s a definite dislike.

Running packed group classes, juggling a busy one on one bookings roster and running multiple marketing promotions that are EXPLODING her business; it?s hard to imagine that just 4 weeks ago Thalia was working FULL-TIME as an Account Manager for an IT company!

That?s why I?ve asked Thalia to write this article about her transition strategy that has allowed her to confidently follow her dream of operating her very own fitness business.

Over to Thalia to explain her transition and how to start a personal training business:

Let?s start with brief introduction.

I?ve always had a passion for Health and Fitness, and it wasn?t until I completed my Cert III and IV that I absolutely realised that this was the industry that I wanted to be in.

I have a background in Education (was a Primary School Teacher for about 5 years) and then moved into an Account Management role for an IT company for 5 years. With these previous two roles in particular, what I did know is that I enjoyed being around people (whether it be children or adults) and helping/teaching/training them but I always felt like there was a missing piece in the puzzle.

The Journey Begins

I?d been attending the local gym for many years and regularly attended fitness classes, boxing in particular. I liked what I saw with the main reason being that I started to see and feel the benefits of boxing after a few sessions!

I had (and still do!) so much energy and felt the fittest I?d ever felt in my life! I started to attend boxing classes at the gym around 3 times per week and found that I was living a happier, healthier and fitter lifestyle.

A couple of things I did find myself questioning was whether my technique was correct ? ?am I doing this right??, which in theory are normal questions with any new exercise you?re introduced to. I decided that I wanted to take it that bit further and started Muay Thai Boxing which was a whole new world and still helps me to this very day on so many different levels ? mentally, physically and emotionally.

I?ve learnt so much about not only myself as a person, but also correct boxing and kickboxing technique and even self defence (great for the women out there!). Anyway, to cut a long story short, I decided to merge the two together (Boxing for Fitness and Muay Thai) and launched my own business (Box it Out). I wanted to share ALL these amazing benefits with others.

Starting Small

The following list is a brief explanation of what I was able to attain and accomplish whilst still being employed full-time, utilising my regualr income to budget and adequately prepare myself for the transition to becoming self employed:

  • Operating a boxing type business does involve some equipment; like gloves, pads, skipping ropes, mats etc. so with some research I was able to get all the initial equipment needed for less than $500.
  • I created and printed up some basic posters just using publisher on my computer and gave them to friends and local businesses, where there is a lot of foot traffic and in stores that I had relationships with.
  • I also uploaded my business information into free online portals like the white Pages, Google Places, Hot Frog and Gumtree. While some of these have been more successful than others; they?re free and it only take a few minutes to do.
  • Utilising people I already new, I was able to negotiate contra-deals on a few expenses that could normally cost quite a lot of money; such as my website and logo in return for free training sessions.
  • I surveyed my clients to establish the best times to suit them and of course myself as I was still full time employed. I didn?t charge for my first few classes as I had to test my programs, times etc. and it was a way to thank my friends for supporting me by coming along to try my classes.

I started running Box it Out Boxing and Kickboxing classes outdoors in the beautiful North Adelaide parklands after work a couple of nights a week and offered mobile PT on weekends.

With no marketing budget to speak of; I started spreading the word just using Facebook, telling family members (and even forced my mum to come out to a few sessions who now attends once a week!), friends and work colleagues. Sure enough, word of mouth kicked in and my classes started to grow in numbers quite quickly. The feedback I was receiving was really positive so I asked my clients to write testimonials for me which are obviously helpful for any business.

Building Up My Client Base

Working as an Account Manager for an IT company was a massive bonus for me, as I had not only gained experience in the sales and marketing world, but I learnt a lot about creating an online presence e.g. Social Media Marketing.

I set up a Facebook Fan Page immediately and started to invite my Facebook friends to ?like? my page. I took photos (and still do!) of almost each class and tag my clients in the photos so that their friends can see. I also encouraged my clients to ?Like? my Box it Out Fan Page as I often post nutritional facts, tips and tricks and photos of them in action.

As mentioned; one of my awesome work colleagues also helped me set up my own website which I?ve found useful for directing clients to when they have questions about timetable, location etc. I don?t tend to use Twitter as much but have linked my Facebook page to my Twitter account (so any posts I make on Facebook are automatically tweeted) and have also set up a YouTube channel where I?ve uploaded a couple of videos.

During this early stage, I was obviously getting a regular income each week and took advantage of this by trying to complete as many Professional Development courses as possible (Punchfit and Metabolic Balance to name a couple). This was not only to develop my own personal/professional development and share and help my clients, but also due to the Continuing Education Credits (CEC) registration requirement as an exercise professional with Fitness Australia.

Taking the plunge!

So after procrastinating for over 6 months, (which also gave me the opportunity to set up most of my processes), I resigned from my full time job as Account Manager and was finally ready to make a few sacrifices (with the obvious being a pay cut) to do what I loved and enjoyed.

I knew it was time to take the plunge, as it got to the point where I didn?t have the time to market my Box it Out business as effectively and wanted to put all my energy into pursing my dream of starting my own business.

I was struggling with the pressures of juggling two jobs and knew that I needed to let one go to make it work. Leading up to my resignation, I definitely needed some professional advice, so spoke to my accountant, bank and financial planner and hit the road running!

What I found extremely beneficial the business coaching I had with Ben London (My Business Is Fitness) which not only helped me with forecasting, marketing ideas, but gave me the push in the right direction with the analysing where I was at (what was important now) and where I was heading. It?s only my second week of being self employed and I can honestly say I won?t be looking back. My advice to you is that if you?re passionate enough about something in life, you can make it work.

I highly recommend starting off small to get a client base before making any drastic moves like quitting your full time job (unless of course you?re one of the lucky ones who happens to have a load of spare cash lying around). Even if you run a regular Saturday morning session with family and a couple of friends, or one night a week after work to slowly start building your client base, word will eventually get around.

Persistence and patience have now become my two best friends.

ATLANTA (AP) ? Would you go to a drugstore to get tested for AIDS?

Health officials want to know, and they've set up a pilot program to find out.

The $1.2 million program will offer free rapid HIV tests at pharmacies and in-store clinics in 24 cities and rural communities, the Centers for Disease Control and Prevention announced Tuesday.

Drugstores now offer blood pressure checks, flu shots and a few other types of health services. Officials are hoping testing for the AIDS virus will become another routine service.

"By bringing HIV testing into pharmacies, we believe we can reach more people by making testing more accessible and reduce the stigma associated with HIV," CDC's Dr. Kevin Fenton said in a statement. He oversees the agency's HIV prevention programs.

The tests are already available at seven places, and the CDC will soon pick 17 more locations.

The HIV test is a swab inside the mouth and takes about 20 minutes for a preliminary result. If the test is positive, customers will be referred to a local health department or other health-care providers for a blood test to confirm the results, counseling and treatment.

When the project ends next summer, CDC officials will analyze what worked well and what didn't, said Paul Weidle, the epidemiologist who is heading up the project.

An estimated 1.1 million Americans are infected with HIV, but as many as 20 percent of them don't know they carry the virus, according to the CDC. It can take a decade or more for an infection to cause symptoms and illness.

Since 2006, the CDC has recommended that all Americans ages 13 to 64 get tested at least once, not just those considered at highest risk: gay men and intravenous drug users.

On special occasions, health organizations have sent workers to some drugstores to offer HIV testing. This week, Walgreens ? the nation's largest chain of pharmacies ? is teaming with local health departments and AIDS groups to offer free HIV testing at stores in 20 cities.

But this CDC pilot program is different: It's an effort to train staff at the pharmacies to do the testing themselves, and perhaps make it a permanent service.

"I'm excited. It's such a new and novel thing for us," said Sarah Freedman, who manages a Walgreens in Washington, D.C., that is participating in the pilot program.

At her pharmacy, the testing is done in a private room. They've also taken steps to make sure that a customer can very quietly request the test. For example, they've put out stacks of special test request cards ? they look like business cards ? at George Washington University and other nearby businesses. Anyone seeking a test can simply hand the card to the clerk, she said.

Only three or four customers have gone through with a test in the first few weeks.

"We get a lot of questions," she said. "Usually they get the information and they go and sit on it and think about it."

There's a second Walgreens in Washington offering the test, as well as branches in Chicago and Lithonia, Ga. Other test sites: East Pines Pharmacy in Riverdale, Md., Mike's Pharmacy in Oakland, Calif. and a federal Indian Health Service location in Billings, Mont.

Each of the locations will get enough tests to check 200 to 300 people.

Cancer, Oral Sex, and Presidential Politics | Psychology Today

The posts on Animals and Us normally deal with the psychology of our relationships with other species. But I am best known at my university as the guy who teaches the sex course. Occasionally a writer needs to clean out the cobwebs by shifting gears a bit. So in this post, I decided to discuss a topic related to the other side of my academic life - human sexuality.

The New Science of Culturomics

One of my favorite toys from the wunderkinds who gave us Google Earth is Google?s Ngram Viewer. Ngram is a free and easy to use graphics program that tracks the ebb and flow of ideas through a culture. At its heart is a massive data set consisting of 500 billion words taken from 5 million digitized books published between 1500 and 2010.

Ngram makes anyone a player in the new science that Ngram devotees call ?culturomics.? Plug the words, names, or phrases you want to track into the search bar and off you go. In a click of a mouse, a graph pops up?showing changes in the relative importance of the concepts over time. Ngram?s uses are endless. For example,?its developers used Ngram to track the Nazi suppression of modern art, and in a previous Psych Today blog I used Ngram to trace changes in the role of pets in American culture.

And I recently used it to test a theory about the rise of oral sex in America.

Reverend Fischer's Oral Sex Hypothesis

Politics is getting particularly dirty as we approach the presidential election, and my foray into the culturomics of sexual behavior was motivated by a recent statement by Reverend Bryan Fischer, a radio commentator and the new darling of the religious right. While you may never have heard of him, his?status as a culture warrior was described by Jane Mayer in a recent article in The New Yorker. Though not as well known as Glen Beck or Rush Limbaugh, his radio show, Focal Point, reaches a million listeners every day ? about the same as MSNBC?s Rachel Maddow.

Fischer is most famous for his gay-bashing diatribes. But in a recent attack on Democrats, he railed against the evils of heterosexual oral sex (which he cryptically refers to as ?the kind of activity that President Clinton practiced in the Oval Office?). Specifically, Fischer made two claims about oral sex on his radio show (here). The first is that oral sex has caused a dramatic increase in the number of cancers of the head and neck in the United States. The second is that Bill Clinton is the culprit. Let?s examine these claims separately.

?Is Oral Sex A Health Hazard?

Reverend Fischer says that oral sex can be bad for your health. He is, unfortunately,?probably right. Cancers of the throat and mouth are on rise, and there are now about 35,000 new cases a year. A 2007 study found that people with cancer of the mouth and throat were considerably more likely to have had multiple oral sex partners than a cancer-free control group. Another study found that oral sex (and even open-mouth kissing) facilitates the transmission of human papillomavirus. (HPV is the malicious family of bugs which sometimes cause genital warts and cancer). But what really got Fischer in a twit was a January 2012 study which found that 7% of Americans aged 14 to 69 are infected with oral HPV. This spells trouble as the most common variety of the HPV in people?s mouths is also among the most carcenogenic.

Oddly, Fischer neglected to mention another STD that is associated with oral sex -- herpes. In times past, the simplex 1 variant of herpes was considered a non-sexually transmitted oral form of the virus which caused cold sores on the mouth and lips. A different form, herpes simplex 2, was thought to cause the STD, genital herpes. But because of the increased popularity of oral sex, particularly among the young, more and more people are showing up at their doctors with cold sore herpes on their genitals. Indeed, at the University of Wisconsin, the proportion of students genital sores caused by herpes simplex 1 jumped from 31% in 1993 (the year Bill Clinton became president) to 78% in 2001 (the year Clinton was replaced by his less kinky successor). Hmmm?..

Using Ngram to Test The Fischer Oral Sex Hypothesis

So, while I hate to admit it, Fischer?s claim that oral sex can cause cancer is probably true. But what about his second claim -- that the former president's ?inappropriate relationship? (Clinton's term) with a White House intern instigated an epidemic of oral sex among the youth of America? Fischer is, of course, dredging up a charge that has made the rounds for years. But now, thanks to Google?s Ngram Viewer, I was finally able to put it to an empirical test.

It was the easiest research project I have ever conducted, and you can replicate it yourself. Here?s how. Pull up Ngram viewer by clicking here. Then type Bill Clinton and oral sex separated by a comma into the search bar. Now limit the dates to the period you are interested in and specify the correct language. (I used the years 1960 to 2000 and American English). Finally, hit enter. Bingo?..

Here?s what I got.

Frequency of "Bill Clinton" (blue) and "oral sex" (red)

In the graph, the relative frequency of usage of the term ?oral sex? is in red and ?Bill Clinton? is in blue. Ngram clearly shows that the rise of oral sex in the American lexicon began nearly three decades before Bill met Monica. The bottom line is that President Clinton had essentially no impact on America?s sexual landscape.

So, sorry Reverend, your theory is wrong. You can't pin the increase of oropharyngeal cancers on Clinton. And when it comes to oral sex, he was product of his times rather than, well, a taste maker.

By the way, I also used Ngram Viewer to test another well-known claim, this one about rock and roll and Christianity. Reverend Fischer would probably approve of the results: John Lennon was wrong - The Beatles were never more popular than Jesus (click here for the graph). It?s not even close.

Legacy Foundation, Lake County?s leading philanthropic partner, funded nearly $1.1 million in grants and scholarships during the first six months of 2012.

?This significant investment in the quality of life and educational attainment of Northwest Indiana residents marks a new milestone for Legacy Foundation,? noted Harry Vande Velde III, president and chief executive officer. ?We are leading the way in creating positive impact through funding that enhances the community, creates an informed and engaged citizenry, and helps youth graduate high school and realize their higher education and career goals.?

Legacy Foundation manages four major funds to support Lake County nonprofit organizations that enhance the quality of life for people throughout the region. From these funds, the foundation has awarded nearly $306,000 in grants so far this year.

Grants make positive impact in the community

Campagna Academy soon will complete construction of an outdoor therapeutic recreation area on its 47-acre Schererville campus thanks to the support of a Legacy Foundation grant. CEO Elena Dwyre said the project features a low ropes course that will improve clinical services to children served by the facility, and will be offered to the community for programs such as leadership skills training. The project had been on the drawing board for some time and would not have been possible without the Legacy Foundation funding.

?This has allowed us to improve and strengthen our services for the children,? Dwyre said. ?(Government) cuts in rates for our services have been quite significant, and without this type of financial support, nonprofits would not be able to add to the services we offer. It is important for us to find collaborative partners like Legacy Foundation.?

In Crown Point, the Adult Learning Center recently moved to new space in the Lakeview Square shopping center. The center currently is helping more than 120 students with GED preparation and English as a Second Language classes. A Legacy Foundation grant helps pay for rent, utilities, internet access and phone service. A second, matching grant will help the board build its fundraising capacity.

?Legacy Foundation?s funding is critical to our very basic needs,? said Carol Borowski, president of Friends of the Crown Point Adult Learning Center. ?If we can?t pay the rent, we won?t have a school. We have been serving adult learners since 1979 and have been in several different locations in town, so we?re pleased to be able to continue the school serving the Crown Point community.?

Updated at 4:50 pm ET In a split decision, the Supreme Court on Monday upheld one part of a tough Arizona immigration law, but struck down other sections.

The Supreme Court has handed down a ruling on Arizona's strict immigration law. NBC's Pete Williams reports.

The part of the law the justices upheld requires police officers stopping someone to make efforts to verify the person?s immigration status with the federal government.

The justices struck down three other parts of the law:

  • One making it a crime for an illegal immigrant to work or to seek work in Arizona;
  • One which authorized state and local officers to arrest people without a warrant if the officers have probable cause to believe a person is an illegal immigrant;
  • And one that made it a state requirement for immigrants to register with the federal government.

"Arizona may have understandable frustrations with the problems caused by illegal immigration" while the federal goverrment tries to enforce immigration law, but the state "may not pursue policies that undermine federal law," wrote Justice Anthony Kennedy in the majority opinion.

The court said that there are several ways for state officials to?cooperate with the federal government on immigration enforcement, such as by responding to federal requests for information about when a particular non-citizen will be released from state custody.

"But the unilateral state action" to arrest and detain suspected illegal immigrants "goes far beyond these measures, defeating any need for real cooperation" between the state and the federal government.

Monday's decision is only a prelude to further litgation over what now remains of the Arionza statute.

NBC?s Pete Williams reported that ?there are other lawsuits against this law. There are several civil liberties groups suing in Arizona, claiming that this law is racial profiling, and those cases have yet to work their way through the courts.?

Monday's decision was a partial victory for President Obama who had criticized the Arizona law, saying it ?threatened to undermine basic notions of fairness that we cherish as Americans.??

Republican presidential hopeful Mitt Romney said Monday, "I would have preferred to see the Supreme Court give more latitude to the states not less. And there are states now under this decision have less authority, less latitude to enforce immigration laws."

He added that immigration policy has "become a muddle. But it didn?t have to be this way. The president promised in his campaign that in his first year he would take on immigration ... put in place a long term program to care for those who want to come here legally, to deal with illegal immigration, to deal with securing our borders. All these things he was going to in his first year he had a Democrat house and a Democrat senate but he didn?t do it. And because he didn?t act, states and localities have tried to act and now the courts trying to get into it and sort things out and it?s a muddle"

Attorney General Eric Holder said in a statement that "I remain concerned about the impact" of the part of the law that requires police to attempt ?to check the immigration status of?people they stop when they have reason to suspect that the person is in the United States unlawfully.

Holder said the Justice Department "will continue to vigorously enforce federal prohibitions against racial and ethnic discrimination.? We will closely monitor the impact of S.B. 1070 to ensure compliance with federal immigration law and with applicable civil rights laws, including ensuring that law enforcement agencies and others do not implement the law in a manner that has the purpose or effect of discriminating against the Latino or any other community."

House Judiciary Committee Chairman Lamar Smith, R-Texas, said flatly that Monday's ruling was a defeat for those who seek stricter enforcement of immigration laws.

Smith?said the decision "limits the ability of states to protect their citizens and communities from illegal immigrants. It is the federal government?s job to enforce our immigration laws, but President Obama has willfully neglected this responsibility. This dereliction of duty has left states to address the crime, job loss, and other costs of illegal immigration."

He added, ?Unfortunately, under this Administration, today?s ruling essentially puts an end to immigration enforcement since the states no longer can step in and fill the void created by the Obama administration."

The Justice Department had moved quickly in 2010 to block enforcement of the law. The administration had argued that the Constitution vests exclusive authority over immigration matters with the federal government, not the states, and that where the federal government has pre-empted state action, no state can intrude on that federal turf.

The majority on Monday essentially agreed with that argument.

In the oral argument before the high court on April 25, Solicitor General Donald Verrilli said Arizona did not have the power to exclude or remove a person who is in the state illegally.

Although some critics of the law have contended that it would inevitably lead to targeting of Latinos simply because of appearance, speaking Spanish, or having a Spanish accent, Verrilli told the justices on April 25 ?We're not making any allegation about racial or ethnic profiling in the case.?

Since enforcement of the law had been blocked by a federal judge soon after its enactment, the Obama administration did not present a record to the Supreme Court of the law leading to incidents of ethnic profiling of Latinos in the state.

Joining Kennedy's?majority opinion?were Chief Justice John Roberts and Justices Ruth Bader Ginsburg, Stephen Breyer and Sonia Sotomayor.

Justices Antonin Scalia, Clarence Thomas and Samuel Alito concurred in part and dissented in part.

Justice Elena Kagan, who served as Obama?s solicitor general, had recused herself from the Arizona case.

The high court?s decision comes just days after Obama announced a new administration policy of not deporting illegal immigrants under age 30 who came to the United States, or were brought to the United States before reaching age 16, who are in school, or have graduated from high school, gotten a general education certificate, or are military veterans. The illegal immigrants covered by the new administration policy will be permitted to apply for authorization to work legally in the United States.?

Zombie-themed cafe offers gamey eating

Nothing says good eatin' like a plague-themed cafe!

Or at least that's what the makers of the famed Resident Evil video games believe. Capcom, the company behind the video?game franchise (which is?known as "Biohazard" rather than "Resident Evil" in Japan), is opening its first Biohazard Cafe & Grill in Tokyo this July.

If you haven't played the Resident Evil/Biohazard games (or, say, seen the movies featuring?Milla Jovovich), they are horror games that center around the spread of a virus that turns people into zombies. Feeling hungry yet?

The Biohazard Cafe, which opens July 13 in Tokyo's Shibuya neighborhood, will feature dance performances (yes, dance performances)?and will only serve dishes for one year.?Check out the official?website here.

I checked in with?Capcom's U.S. office?and they?confirm the cafe is for real?(despite the misspelling at the top of the?web page.) They say the official translation is as follows:

?The very first official Biohazard brand themed restaurant?opens on 13th July 2012 inside Shibuya Parco Part 1 building, it's called"Biohazard Cafe & Grill S.T.A.R.S.". Performance by the?dance troop "S.T.A.R.S. Angelique" is planned, in addition, some?limited Biohazard items can be sold only at this location.
